In the Court’s view, the contested Decision does not provide clear and unequivocal reasons as to why the tax regime for agricultural cooperatives, as regards tax on capital transfers and documented legal acts, tax on economic activities, and tax on immovable property, does not constitute an advantage within the meaning of Article 107(1) of the TFEU.
12. Any waiver of the right to translation of documents referred to in this Article shall be subject to the requirements that suspected or accused persons have received prior legal advice or have otherwise obtained full knowledge of the consequences of such a waiver, and that the waiver was unequivocal and given voluntarily.
